Mphwiyo case adjourned to Feb 17: Mwakhwawa quizzes him on his JB relationship Judge

Lilongwe High Court Judge Justice Michael Mtambo on Wednesday
adjourned a case which lawyer Ralph Kasambara, Pika Manondo, Robert
Kadzuwa and Macdonald Kumwembe are charged with attempted murder case
and conspiracy to commit murder on former Ministry of Finance Budget
Director Paul Mphwiyo to February 17.


The case will run for three days up to February 19.

The suspects pleaded guilty to charges.

As the hearing resumed in the morning after a long break marred with
judiciary strike, Director of Public Prosecution (DPP) Mary Kachale
sought for an adjournment after realising that the fifth accused
person Osward Lutepo was not in the court.

The defence team comprised of Wapona Kita, John Gift Mwakhwawa and
Kasambara himself agreed but Justice Michael Ntambo opted to continue
with the case.

Ntambo said so many adjournments are just dragging the conclusion of
the case saying he want it concluded by May.

Before wrapping his cross examination, Kasambara quized Mphwiyo how he
know Lutepo and if they used to call each other on the phone.

Mphwiyo responded by saying he knew Lutepo through Naming'omba Tea
Estate and that they used to call each other.

During cross examination in the afternoon, Mwakhwawa asked Mphwiyo how
he knew former president Dr Joyce Banda, to which he answered he knew
her long time ago when she was running FINCA.

On why he sold the Toyota Fortuner which he was driving at the time of
his shooting, Mphwiyo said it was because the vehicle was bringing bad
memories into the family.

Meanwhile, Ntambo has ordered the state to find a psychiatric expert
to examine Lutepo if he is normal.

He also ordered that if he is to be found of sound mind, he should
take plea on February 17.
